1. Acceptance of Terms

Welcome to OutboundAI ("we," "us," or "our"). By creating an account, subscribing to any plan, or otherwise using our AI-powered GTM engineer platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Important: These Terms constitute a legally binding agreement between you and OutboundAI. By using the Service, you confirm that you are at least 18 years old and have the authority to enter into this agreement.

2. Description of Service

OutboundAI provides an AI-powered Go-To-Market engineer platform that helps businesses find leads, research prospects, and generate personalized outreach. Our Service includes:

  • Natural Language ICP parsing - describe your ideal customer in plain English
  • Multi-source data enrichment from Apollo, ZoomInfo, LinkedIn, Clearbit, and Hunter
  • Real-time signal detection (funding rounds, hiring sprees, job changes)
  • AI-powered personalized email generation
  • One-click integration with Instantly for campaign management

This Service is a digital SaaS product delivered immediately upon payment confirmation.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

If you represent a company or organization, you confirm that you are authorized to bind that entity to these Terms.

4. Subscription Plans

We offer the following subscription plans:

  • Free: 100 leads/month, basic ICP parsing, email verification, CSV export
  • Professional ($49/month): 5,000 leads/month, advanced ICP + signals, deep research agent, AI personalized emails, Instantly integration
  • Enterprise ($199/month): Unlimited leads, priority data sources, custom integrations, dedicated support, SSO

We reserve the right to modify plan features or introduce new plans. Price changes will be communicated in advance.

5. Billing and Payment

5.1 Auto-Renewal Authorization

By providing a payment method and subscribing to a paid plan, you authorize OutboundAI to automatically charge your payment method at the start of each billing cycle. This authorization remains in effect until you cancel your subscription.

5.2 Billing

Subscription fees are billed monthly or annually in advance. Annual subscriptions will receive a renewal reminder before the billing date.

5.3 Payment Processing

All payment card data is processed by our PCI-DSS compliant payment processor, Waffo Pancake. We do not store your full payment card number on our servers.

5.4 Taxes

Prices shown do not include applicable taxes (VAT, GST, sales tax, etc.). We will collect and remit taxes where required by law.

6. Cancellation Policy

6.1 How to Cancel

You may cancel your subscription at any time through your account settings (Account Settings → Subscription → Cancel), or by sending a cancellation request from your registered email to cancel@outboundai.com.

6.2 Effects of Cancellation

  • Your subscription remains active until the end of the current billing period
  • No further charges will be made after cancellation
  • Account data will be retained for 90 days after cancellation, then deleted per our Privacy Policy

7. Refund Policy

Due to the immediate delivery nature of our digital Service, subscription fees are generally non-refundable, except in the following cases:

  • 7-Day Guarantee for New Subscribers: First-time subscribers may request a full refund within 7 days of their first charge, provided usage does not exceed 10% of the plan quota.
  • Duplicate Charges: Full refund for any billing errors resulting in duplicate charges.
  • Verified Service Interruption: If our Service is unavailable for more than 72 consecutive hours due to our fault, you may receive a prorated refund or service credit.
  • Legal Rights: Where applicable law grants cancellation or refund rights (e.g., EU/UK 14-day cooling-off period), these rights are preserved.

To request a refund, contact refunds@outboundai.com with your account email, transaction ID, and reason for the request. We will confirm receipt within 2 business days and process eligible refunds within 5-10 business days.

8. Billing Disputes

If you believe there is a billing error, please contact us at billing@outboundai.com before initiating a dispute with your bank or payment provider. We commit to responding within 2 business days and resolving confirmed billing errors within 5 business days.

9. AI Content and Intellectual Property

9.1 Output Content Ownership

Subject to these Terms, AI-generated content produced through your use of the Service ("Output Content") belongs to you. You may use Output Content for any lawful purpose consistent with Section 10 (Acceptable Use).

9.2 Input Content License

By submitting content to the Service ("Input Content"), you grant OutboundAI a limited, non-exclusive license solely to provide the Service to you. We will not use your Input Content for AI model training without your explicit consent.

9.3 Third-Party AI Models

This Service uses third-party AI model providers including [OpenAI, Anthropic, Google]. Output Content may be influenced by these providers' models. We do not guarantee specific output quality and are not responsible for third-party model-generated content.

9.4 AI Output Accuracy

⚠️ AI-generated content may contain inaccuracies or outdated information. You are responsible for reviewing and verifying Output Content before relying on it.

10. Acceptable Use Policy

10.1 Permitted Uses

You may only use the Service for lawful purposes consistent with these Terms, including personal productivity, business automation, and research activities.

10.2 Prohibited Uses

You agree NOT to use the Service to:

  • Generate illegal, defamatory, harassing, or fraudulent content
  • Generate, distribute, or assist in creating deepfake content, including AI-synthesized audio, video, or images impersonating real individuals
  • Generate content involving the sexualization of minors or violation of child protection laws
  • Create malware, phishing content, or cyberattack tools
  • Infringe any third party's intellectual property or privacy rights
  • Bypass or interfere with the Service's security features
  • Resell or sublicense access without prior written approval
  • Send unsolicited commercial email (spam) in violation of applicable laws (CAN-SPAM, GDPR, CASL)
  • Use data obtained from the Service for purposes other than your own outbound marketing
  • Violate any applicable laws, regulations, or card network rules

10.3 AI-Specific Prohibitions

In addition to the above, given the AI nature of this Service, you agree NOT to:

  • Use the Service's input, output, model responses, or any derivative data to train, fine-tune, benchmark, or develop any AI or machine learning model that competes directly or indirectly with OutboundAI
  • Systematically scrape, extract, or collect model outputs for purposes beyond your authorized personal use
  • In harmful contexts, misrepresent AI-generated content as produced by human professionals (licensed doctors, lawyers, or financial advisors)

11. Data, Privacy, and Security

Your use of the Service is governed by our Privacy Policy. Payment card data is processed exclusively by our PCI-DSS compliant payment processor, Waffo Pancake, and is not stored on our servers. Account data is retained for 90 days after cancellation, then deleted per our Privacy Policy.

12. Disclaimers and Limitation of Liability

12.1 Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, including merchantability, fitness for a particular purpose, or AI output accuracy.

12.2 AI Content Disclaimer

⚠️ AI-generated content may be inaccurate, incomplete, or outdated. Do not use it for legal, medical, financial, or other professional advice. Always verify with qualified professionals before acting on AI content.

12.3 Limitation of Liability

To the maximum extent permitted by law, OutboundAI is not liable for any indirect, incidental, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Term and Termination

These Terms remain in effect while you use the Service. We may suspend or terminate your account if you materially breach these Terms, engage in fraud, or if required by law. If we terminate for reasons not caused by you, we will prorate-refund any prepaid, unused portion.

You may delete your account at any time by contacting support@outboundai.com.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which OutboundAI is established. For formal proceedings, please contact legal@outboundai.com to attempt informal resolution first.

15. General Provisions

We may update these Terms at any time. Material changes will be communicated at least 14 days in advance via email. Continued use constitutes acceptance of revised Terms. If any provision is found invalid, the remaining provisions remain fully effective.
